You guys remember my post about my dog Sophie right? Does a little Jack Russell Terrier look like a vicious dog? No? I thought so. Anyways, Sophie does have a problem of running out the front door when we answer it, or when we're leaving. Well today when my sister, her friends and I were all leaving, Sophie runs out the door. She runs over to the neighbors across the street who own a pitbull and like most dogs she barks at it. The pitbull knocks down the fence and gets out, but instead of chasing after Sophie, he wanders around. When the neighbors two children try to get their pitbull, Sophie runs up to them like she usually does when she sees people, but not chasing them. My sister catches Sophie and the two kids were able to catch their dog. Now here's where the problem starts, my dad goes over to the neighbors house to appologize and even made an offer to fix their fence. What do the neighbors do? they yell at my dad saying the following (I'm not kidding) "If your dog ever gets out again and bites my kids, I will kill it!" then he threatens to call animal control. Then after that, my sister and I head over to PetsMart to find an invisible fence to keep Sophie from running out the front door. Unfortunately they are very expensive, so instead we get a spray that is designed to keep your pets away from areas that you use it on. When my sister and I got back home, we learn that our neighbors really did call animal control and guess who got the $25 dollar fine... us! Here's the crazy part, animal control told my dad that we have to keep our dog under control and if Sophie is in our neighbors' yard, they have the right to kill her. I don't think that's right. I think the neighbors exagerated to animal control because my dad told me that they claimed that Sophie chased after the kids. If you look at Sophie's picture, does that look like a dog who would chase and bite children!? Forgot to tell you guys, the neighbors kids are 9 and 12 years old, did I mention that they have a Pitbull that I've never seen being taken for a walk and kept locked up in their backyard!
I'm going to look up the animal laws and see if it is true that a person has the right to kill a dog that is on their property.

Boy Chick, you must be fuming! I would be sooo mad! I can't believe the animal control people believed your neighbour. I mean, who broke down the fence??? And did they bother to check out the story and see if your doggie really was going to chase kids? That's crazy. Accidents happen and dogs get out occasionally. Last night, I found one of the barge owners dogs here outside my boat quite late. Her boat is in the next harbour about half a mile away. Luckily I knew it was her dog and took it home. She apologised, I said no problem, these things happen! End of story. Hmmm I seem to have got worked up here, but at least you know you have some support, Chick!!

grrrr!!..i get insensed when i hear stuff like this..can you dispute it etc?...f***ing arseholes...im my mind you and your dad tried to rectify a situation that got out of hand but NO ONE was hurt!!!..people like your neighbours make me sad..and the laws are an ass...oh btw g SAID YOU ARE FORGIVEN..>;0)...
Hi Chick, couldn't help but see your comment on Gypsy's post. I really respect your feelings and what you say, but maybe this puts things in perspective. A) I'm convinced God has a sense of humour. He wouldn't have created dogs if He didn't! or us! and B) There are so many sick crimes being committed in the world in the name of religion that I even heard a radio programme the other day where it was stated as fact that in a survey, the people questioned (devotees of several religions) were prepared to forgive crimes like gang rape and child abuse sooner than have their religion criticised. That sounds like a world gone mad to me.
Russells, in my experience, simply bark a whole lot and yet in Marbella, at Victor's Beach, there was a Jack Russell that swam ALL DAY in the sea. That dog went WAAAAY out, way-way out, and he'd swim to shore and then we'd turn our heads and yikes he was way out there again.
I'd only seen him eat some fries at lunch and so I knew he'd swam off all his lunch and yesterday's and his energy--well, he's probably still asleep. He sat on the shore tho for a spell and I noticed he was trembling but good, like a diabetic, so I went to him knowing he didn't understand a lick of English. But I pet him and he was alright with it. The shakes lessened--maybe he wsa cold. And then he very politely looked at me and moved a little away from me, to gear up to take another wave.
His owner,by the way, was WAAAY out there too.

Unfortunately there are alot of people like that! Still no excuse though!
That's terrrible. I hate arguments with neighbors, particularly ones who have pitbulls. Be careful. A friend of mine was a student of the lacross teacher in san francisco who was mauled in her apartment hallway by a pitbull, they are vicious killers, quite unpredictable dogs.
On the traffic thing, my guess is she may have told the police my license plate, but what would they do? All they have is her side of it, and I bet she never told them about the tailgating part. I'd be very surprized if they followed up. Well, had better get ready for work. Hope things work out with your neighbor.
I've just read a part of your animal laws, Chick, and it sounds to me that the control officer should ahve 'investigated' a bit further to establish probable cause for complaint. If you feel like it, you could probably make a complaint yourself here. BTW I'm afraid of Pitbulls myself, and just LOVE Jack Russels.
Call Animal Control and talk to someone about the incident. If they claimed that your dog "bit" the kids, they'd want to see the proof of it.
Keep you dog inside, trouble's brewing. Tried an obedience class yet? Petsmart has them for puppies and older dogs, too.
Seems to me Val is right. That guys interpretation of the laws you posted is WAY out of line. Neither would he have the authority to be making the final judgement.
